Affiliate Terms

These terms are an agreement between Nagi Consulting Group Inc., a company based in Calgary, Alberta, which operates Othermile ("Othermile", "we", "us"), and the person who joins the Othermile affiliate program ("you"). You accept them when you tick the box and press Get my link in Refer and earn in the Othermile app. Our Terms of Service, Acceptable Use Policy and Privacy Policy also apply to your account.

Who can join

You must be at least 18, have an Othermile account in good standing, and be able to receive payments by PayPal or Interac transfer. You may not join if you live in, or are covered by sanctions of, a place that Canadian or US sanctions apply to. Othermile staff may not earn on the program.

How a referral counts

  • When someone opens your link, their browser remembers your code for 60 days. If several affiliates' links are opened, the last one opened counts.
  • A referral counts when a new business signs up on that browser within those 60 days. A business that already had an Othermile account, or that signed up without your link, does not count, and we do not move a business from one affiliate to another.
  • You may not refer yourself, a business you own or work for, or a business you sign up on someone else's behalf.
  • Our records decide whether a referral counts. If our system missed one, tell us within 30 days of the sign up and we will look into it.

What you earn

  • You earn 30% of each payment we actually receive from a business you referred, for 12 months from its first payment. Payments include what the business pays us through Stripe and what it pays for Othermile on its Shopify bill.
  • Amounts are before sales tax, GST, HST, VAT and similar taxes, and after any discount, credit or promotion code.
  • If a payment is refunded, credited back or disputed, what it earned is taken off your balance, including from earnings that are ready or will be paid later.
  • Earnings are in US dollars.

Getting paid

  • Each payment's earnings become ready 30 days after the payment.
  • Once a month we pay everything ready, when it adds up to US$50 or more, by PayPal or Interac transfer to the address you saved in Refer and earn. Less than US$50 carries over to the next month.
  • You are responsible for giving us correct payout details. A payment sent to the details you saved counts as paid.
  • Any fee your PayPal account or bank charges you is yours.
  • You are responsible for reporting your earnings and paying any tax on them, including collecting and remitting GST or HST if you are registered for it. We may ask for the tax information the law requires before we pay you.

How you promote Othermile

You must:

  • say that you earn from Othermile when you share your link, in a way people notice before they click (for example "I earn a commission if you sign up"), as the Competition Act in Canada and the FTC's endorsement rules in the United States require;
  • describe Othermile accurately: it gives estimates of duties, taxes and fees, not customs advice, and it never certifies origin or files customs entries;
  • follow anti spam laws, including Canada's Anti Spam Legislation (CASL) and the US CAN SPAM Act, and send messages only to people who agreed to hear from you.

You must not:

  • send spam, post your link where it is not welcome, or use bots, fake accounts or paid traffic that is not real people;
  • bid on "Othermile" or similar words in search ads, or use our name in a domain, a social media name or an app;
  • set our cookie without the person choosing to open your link, hide your link inside other pages, or offer people money or gifts to sign up;
  • promise savings, exact amounts or results, or say Othermile is endorsed by any government, carrier or platform;
  • use our logo or screenshots except as they appear on our website, or change them.

Our rights

  • We may switch off your link and hold back earnings at any time if we reasonably believe you broke these terms, or if referrals look fraudulent. Earnings from referrals that broke these terms are never owed.
  • We may change these terms, the rate or the program. We will email you at least 30 days before a change that lowers what you earn, and earnings from payments made before the change keep the old terms.
  • We may end the program, or you may leave it, at any time. If it ends, or you leave, we pay what is ready and owed under these terms within 60 days, even if it is less than US$50, except earnings held back under these terms.
  • If your Othermile account is closed, your link stops and these terms end.

Relationship

You are an independent affiliate, not our employee, agent, partner or representative. You may not make promises, sign agreements or accept money on our behalf. These terms are not exclusive: you may promote other products, and we may work with other affiliates.

Liability

The program is offered as it is. To the extent the law allows, our total liability to you under these terms is limited to the earnings paid or owed to you in the 12 months before the claim, and neither of us is liable for indirect or consequential losses. You are responsible for your own promotion and will cover our losses from any claim caused by your breaking these terms or the law.

General

The laws of Alberta and the federal laws of Canada that apply there govern these terms, and the courts in Calgary, Alberta have exclusive jurisdiction. If part of these terms cannot be enforced, the rest still applies. These terms are the whole agreement about the program.
